Terms of Sale & Website Use

These terms (“Terms”) govern your access to copperbody.com.au (the “Website”) and any purchase of goods offered on the Website (“Products”). By using the Website or placing an order, you agree to these Terms.

If you do not agree, you must not use the Website or complete a purchase. Certain rights cannot be excluded under the Australian Consumer Law (“ACL”). Nothing in these Terms limits those non-excludable rights.

1. Eligibility and information

1.1 You represent that you have the legal capacity to enter a contract in your place of residence and that information you provide (including delivery details) is accurate and complete.

1.2 Products are pet recovery wear. They are not a substitute for veterinary diagnosis or treatment. Always follow your veterinarian's advice on sizing, fit, and post-surgical care.

2. Orders, acceptance, and pricing

2.1 Display of Products on the Website is an invitation to treat. Your order is an offer. We may accept or decline an order (for example, due to stock, suspected fraud, or incorrect pricing). A contract is formed when we accept your order and process payment in accordance with our checkout flow.

2.2 Prices are in Australian dollars and include GST where applicable. We may correct errors (including pricing or description errors). If we cannot fulfil your order at the correct price, we will notify you and may cancel the order and refund any amount paid.

3. Payment

3.1 Payment is processed at checkout through our payment provider (currently Stripe). You authorise us and our provider to charge your selected payment method for the total amount shown (including applicable shipping).

3.2 You must not use a payment method you are not authorised to use. We may refuse or cancel orders that fail security or verification checks.

4. Shipping and risk

4.1 We deliver to addresses within Australia unless we state otherwise. Delivery options, costs, and timeframes shown at checkout are estimates and are not guaranteed.

4.2 Risk of loss or damage to Products passes to you when the Products are delivered to the address you provided or collected in accordance with the carrier's proof of delivery.

4.3 We are not responsible for delays caused by carriers, events outside our reasonable control, or incorrect details you supply.

5. Returns, refunds, and Australian Consumer Law

5.1 Our Products come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement, repair, or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality, even if the failure is not a major failure.

5.2 For change-of-mind returns (where we choose to offer them), hygiene and pet-wear considerations may apply. Generally, we cannot accept change-of-mind returns for Products that have been worn, soiled, washed, altered, or are otherwise not in saleable condition, or outside any return window we specify on the Website from time to time.

5.3 If you believe a Product is faulty, please contact us promptly at info@vsms.com.au with your order number and a description of the issue.

6. Promotions and stock

6.1 We may run promotions subject to additional terms. Products may go out of stock; we will use reasonable efforts to update availability but do not warrant that any item will always be in stock.

7. Community submissions, testimonials, and monthly favourites

7.1 If you submit a photo, testimonial, recovery story, or similar content to us, you confirm that you own it or have the right to share it and that it does not infringe any third-party rights.

7.2 By submitting content through our story or testimonial features, you grant us a non-exclusive, royalty-free licence to review, store, reproduce, publish, and use that content for CopperBody marketing, website, email, and related promotional purposes, subject to the permissions you give us at the time of submission.

7.3 We may edit submissions for length, clarity, formatting, or suitability, and we may choose not to publish any submission at our discretion.

7.4 Where we mention a monthly favourite, prize, gift, or similar thank-you, selection is entirely at our discretion unless we publish more specific promotional terms. Submission does not guarantee publication, selection, or a prize.

8. Website use

8.1 You agree not to:

misuse the Website or attempt unauthorised access to our systems;
use the Website for unlawful purposes;
interfere with other users or impose an unreasonable load on our infrastructure;
scrape or harvest data except as permitted by law;
reverse engineer or circumvent security or payment flows.

8.2 We may suspend or restrict access where we reasonably believe Terms are breached or the Website is at risk.

9. Intellectual property

9.1 Content on the Website (including text, graphics, logos, and layout) is owned by or licensed to us. You may not copy, reproduce, or exploit it without our prior written consent except as permitted by law.

10. Liability

10.1 To the fullest extent permitted by law, we exclude liability for indirect or consequential loss arising from use of the Website or Products, except where the ACL applies.

10.2 Where our liability cannot be excluded but may be limited under the ACL, our liability is limited to resupplying the goods or paying the cost of resupply, at our option.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy.

12. Governing law

These Terms are governed by the laws of Western Australia. Each party submits to the non-exclusive jurisdiction of the courts of Western Australia.

13. Changes and contact

13.1 We may update these Terms from time to time by publishing a new version on the Website. The effective date above will be revised. Continued use after changes may constitute acceptance where permitted by law.
